Tania Walrath and The Bryan E. and Tania C. Walrath Family Irrevocable Trust sues 10 Stars Property Management LLC and RK Capital LLC for negligence leading to property damage

In the Circuit Court of the Sixth Judicial Circuit in and for Pinellas County, Florida, Tania Walrath and The Bryan E. and Tania C. Walrath Family Irrevocable Trust have filed a lawsuit against 10 Stars Property Management LLC and RK Capital, LLC. The case, numbered 24-001476-CI, was filed on April 2, 2024.

The plaintiffs, represented by their counsel, claim that the defendants negligently failed to maintain an air conditioning unit at a property located above theirs. This negligence resulted in water leakage causing extensive water and mold damage to the plaintiff's property located at 1200 Country Club Drive, Unit 5104, Largo, FL 33771. The cost of damages is stated to exceed $50,000 exclusive of attorneys’ fees, pre-judgment interest, and costs.

The lawsuit alleges that RK Capital hired an unlicensed contractor to install a new air conditioning unit without obtaining the necessary permit. This improper installation led to water leaking into the plaintiff's property causing significant damage.

The plaintiffs are seeking judgment against RK Capital LLC for all damages they are entitled to along with pre-judgment interest. They also seek compensation for attorney’s fees, expert fees, costs and any other relief deemed reasonable by the court.
