City of Miami faces suit over denying establishment of medical marijuana centers

MIAMI — The City of Miami is facing a lawsuit over its denial of the establishment and operation of two medical marijuana treatment centers. 

MRC44 LLC and 60 NE 11th LLC filed a complaint in April in Miami-Dade Circuit Court against Miami, which removed the case to federal court in May.

According to the complaint, the plaintiffs are seeking to operate two medical marijuana treatment centers within the city of Miami. They allege that the City is falsely denying their operation of the centers due to city zoning and permitting restrictions. 

The plaintiffs claim that there are no city ordinances banning the medical marijuana treatment centers from being in the city as well as any ordinances “determining the criteria for the location of, and other permitting requirements” for the treatment centers. The plaintiffs are also disputing the City of Miami's claims of Florida Building Codes restrictions as well as Florida Fire Prevention Code and local amendments.

The plaintiffs seek a declaratory judgement and all other just relief. They are represented by Richard Beauchamp and Benjamin Bean of Panza, Maurer & Maynard PA in Ft. Lauderdale.
