11-year-old girl sent on flight by herself was sexually assaulted by Delta flight attendant, lawsuit says

MIAMI - Delta Airlines faces charges in Florida federal court from an anonymous mother and her 11-year-old daughter after a Delta flight attendant allegedly sexually assaulted the child on a flight. 

According to a lawsuit filed on March 5, the daughter, MS, was flying alone from Fort Lauderdale to Sydney, Australia, in December 2020. She was escorted to her seat by a flight attendant who allegedly stayed inappropriately close to the child. 

Over the course of a five-hour leg of the trip, the child was allegedly sexually harassed, molested and inappropriately touched by the attendant, including running his hands up and down her body, calling her beautiful and saying "I love you."

The attendant also allegedly told the minor child to "come off the plane with him" when it landed and that he would "show her where to go."

The plaintiffs say that the many other flight attendants on board either saw the inappropriate contact and did not take action or were not paying an appropriate amount of attention. 

The child reported the incident to police upon landing. 

The mother is seeking damages for her daughter's emotional and mental suffering under the Montreal Convention, and demands a jury trial. The plaintiffs are represented by Halpern, Santos and Pinkert PA of Coral Gables.
