Couple alleges paint business' negligence caused husband's injuries

CLEARWATER — A Pinellas County couple is suing a St. Petersburg paint business owner and contractor, alleging loss of consortium and negligence in the injuries of the husband.

Richard J. Neefe Jr. and Heather Neefe filed a complaint Dec. 21 in Pinellas County Circuit Court against HCM Inc., ABR Properties LLC, Sherwin-Williams Company and Extreme Painting & Contracting Inc., alleging failure to follow applicable safety guidelines and regulations.

According to the complaint, on July 18, 2018, while Richard Neefe was in defendants' premises at 3201 34th St. S., St. Petersburg, as an employee, he slipped and fell while walking on the floors due to the unsafe condition of the flooring. As a result of defendants' negligence, the suit says, Neefe suffered injuries and damages, while his wife and co-plaintiff has lost her husband’s services, companionship and consortium. 

The plaintiffs allege the defendants failed to apply proper materials and coating for the floors, failed to properly warn invitees of the dangerous condition on their premises and failed to correct the hazardous condition of the floors.

The Neefes seek trial by jury, damages in excess of $15,000, plus costs of suit. They are represented by attorney Joseph W. Chambers of Chambers Law Group PA in St. Petersburg.
