Coral Springs property owners allege insurer failed to cover hurricane damage

FORT LAUDERDALE — Two Coral Springs property owners are suing an insurer, alleging breach of contract.

Venoute Fabien and Mimose Gedeon filed a complaint Oct. 1 in Broward County Circuit Court against Universal Property & Casualty Insurance Company, alleging failure to pay for damages caused by a hurricane. 

According to the complaint, on Sept. 10, 2017, while the plaintiffs' Universal insurance policy was still in full force and effect, their property at 12362 NW 27 Place, Coral Springs, sustained a covered loss from Hurricane Irma. However, the suit says, the defendant has denied the plaintiffs' claim for the loss despite having previously assigned a claim number and conducted an inspection of the Coral Springs property. 

The plaintiffs allege Universal Property & Casualty Insurance breached the policy by failing to provide coverage or payment for losses to the plaintiffs' property, and obligated the plaintiffs to retain legal counsel to protect their interest.

Fabien and Gedeon seek trial by jury, damages of more than $15,000, plus interest, court costs and attorney fees. They are represented by attorney Matthew A. Barket of Barket Law PA in Miami.
