Miramar homeowners sue United Property & Casualty for breach of contract

FORT LAUDERDALE — Homeowners are suing United Property & Casualty Insurance Co., citing alleged breach of contract, after their claim of damages from Hurricane Irma was not paid in full. 

Alex Amoako and Ernestina M. Gonzalez filed a complaint on July 18, in the Broward Circuit Court, alleging that the insurance carrier breached its duty of good faith and fair dealing.

The plaintiffs claim that on Sept.10, 2017, their home at 1823 SW 180th Terr. in Miramar, Florida, sustained substantial damage from Hurricane Irma. The couple claimed the damages were covered under their policy, and that they filed a timely notice of loss.

The plaintiffs allege that United Property & Casualty refused to pay the full amount of their insurance claim. 

The plaintiffs claim the defendant failed to comply with the terms of the insurance policy.

The plaintiffs request a trial by jury and seek judgment against defendant for damages, costs, interest, and attorney's fees. They are represented by Aylin Morales of Militzok & Levy PA in Hollywood.
