ORLANDO — An employee is suing a disposal service, alleging breach of contract for unpaid wages and refusal to provide workers' compensation claim.

Willie Parker, Jr. filed a complaint on Jan. 3 in the 9th Judicial Circuit Court of Florida - Orange County against Disposall Inc. alleging the company violated the Fair Labor Standard Act.

According to the complaint, the plaintiff alleges that on June 16, 2017 he was injured in the course and scope of his employment while working on a garbage route. The plaintiff claims he notified the defendant that he sustained an injury and filed a claim for workers' compensation benefits, but instead was allegedly terminated from his employment. He also alleges he failed to receive overtime compensation throughout his period of employment.

The plaintiff holds Disposall responsible because the defendant allegedly intentionally discharged an employee for seeking workers' compensation benefits, and failed to pay overtime compensation at a rate of time and a half of his regular rate of pay for hours worked over 40 in a workweek.

The plaintiff requests a trial by jury; and seeks judgment for the payment of all overtime hours, plus liquidated damages, attorneys' fee, costs incurred, and all further relief that the court determines to be just and appropriate. He is represented by Christopher R. Turner and Jesse D. Rowe of Christopher R. Turner, PLLC in Orlando.
