Liberty Mutual Insurance, Rainbow International of St. Petersburg accused of breach of contract

CLEARWATER — An individual is suing Liberty Mutual Insurance and Rainbow International of St. Petersburg for alleged breach of contract, negligence and unjust enrichment.

Mary D. Dasilva filed a complaint on Aug. 11 in the Pinellas County Circuit Court, alleging that the defendants breached their duty of good faith and fair dealing.

According to the complaint, the plaintiff alleges that her property sustained a covered loss on March 6 due to fire, smoke and water damage. Consequently, Liberty, as the plaintiff's insurer, allegedly hired Rainbow to fix the damage to her property. However, the plaintiff's property allegedly was not repaired to its pre-loss condition. 

The plaintiff holds the defendants responsible for allegedly refusing to fully cover her claim for insurance benefits, honor their obligation to repair her property to its pre-loss condition and for allegedly causing additional damages to her property that further diminished its value.

The plaintiff requests a trial by jury and seeks judgment against the defendants for damages, plus interest, costs and any further relief the court deems just. She is represented by Warren P. Duffy and Jason A.Herman of Herman & Wells PA in Hillsborough Park.
