Local McDonald's accused of negligence

ORLANDO — An individual is suing Oerther Foods Second Generation Inc. d/b/a McDonald's Restaurants for alleged negligence.

John W. Kaufman Jr. filed a complaint on Aug. 1 in the Orange County Circuit Court, alleging that the defendant failed to provide its patrons with a safe environment.

According to the complaint, the plaintiff alleges that he was at the defendant's restaurant on Feb. 4 and allegedly sat on a defective chair that collapsed, causing him to fall to the ground and sustain bodily injury, pain and suffering, disability, physical impairment, disfigurement, mental anguish, inconvenience, the aggravation of an existing condition and medical expenses. 

The plaintiff holds the defendant responsible for allegedly failing to adequately inspect and maintain the condition of its furniture, and for allegedly failing to warn him of the dangerous conditions of the chair.

The plaintiff requests a trial by jury and seeks judgment against the defendant for damages in excess of $15,000 plus costs and other such relief deemed proper by the court. He is represented by Gregory S. Stark of Todd K. Miner PA in Orlando.
