Tower Hill Prime Insurance Company accused of breaching insurance contract

FORT LAUDERDALE — Two individuals are suing Tower Hill Prime Insurance Company for alleged breach of contract.

Mark and Michelle Eisenfeld filed a complaint on July 31 in the Broward County Circuit Court, alleging that the defendant breached its duty of good faith and fair dealing.

According to the complaint, the plaintiffs allege that their property suffered damages on or around Nov. 21, 2016 due to water damage. The defendant allegedly has refused to pay benefits despite allegedly acknowledging the plaintiffs' claim and assigning them a claim number. 

The plaintiffs hold the defendant responsible for allegedly forcing them to hire attorneys, and for allegedly breaching its contractual obligation to protect the plaintiffs from covered losses.

The plaintiffs request a trial by jury and seek judgment against the defendant for benefits, pre-judgment interest, costs, attorneys' fees and other relief the court deems proper. They are represented by Michael D. Leader of Leader & Leader PA in Fort Lauderdale.
