Avatar Property and Casualty Insurance Company accused of breach of contract

ORLANDO — Two individuals are suing Avatar Property and Casualty Insurance Company for alleged breach of contract.

Luis and Elsa Rosales filed a complaint on June 23 in the Orange County Circuit Court, alleging that the defendant breached its duty of good faith and fair dealing.

According to the complaint, the plaintiffs allege that their property was damaged on March 26, 2016 after water allegedly entered the property via the roof. Though the plaintiffs allegedly notified the defendant of the damages, the defendant allegedly failed to cover them.

The plaintiffs hold the defendant responsible for allegedly failing or refusing to extend coverage and pay all of the plaintiffs' damages, and for allegedly obligating the plaintiffs to pay for an attorney's services to bring action.

The plaintiffs request a trial by jury and seek judgment against defendant for all unpaid and overdue insurance benefits with interest, costs, attorney fees and for all other remedies the court sees fit. They are represented by Scott G. Millard of Cohen Grossman, Attorneys At Law in Maitland.
