Mercedes Benz of South Orlando accused of negligence

ORLANDO — A business invitee is suing Boyland Auto Orlando LLC d/b/a Mercedes Benz of South Orlando for alleged negligence.

Martin Agosto Jr. filed a complaint on June 23 in the Orange County Circuit Court, alleging that the defendant failed to provide a safe environment for its business invitees.

According to the complaint, the plaintiff alleges that he suffered bodily injury after he slipped and fell on algae that had allegedly accumulated on the curbside of the defendant's parking lot. The plaintiff claims that he suffered pain and suffering, disability, mental anguish, loss of earnings and the aggravation of a pre-existing condition.

The plaintiff holds the defendant responsible for allegedly allowing a dangerous condition on its premises, and for allegedly failing to warn him of the dangerous condition that it should have known of.

The plaintiff requests a trial by jury and seeks judgment against the defendant for damages and costs. He is represented by David Kerce of Farah & Farah PA in Daytona Beach.
