JM Auto Parts Enterprises Inc. allegedly fired employee over cancer treatment

FORT LAUDERDALE — A former employee is suing JM Auto Parts Enterprises Inc. for alleged discrimination.

Gerhard Elwert filed a complaint on June 12 in the Broward County Circuit Court, alleging that the defendant breached its duty of good faith and fair dealing.

According to the complaint, the plaintiff alleges that he suffered loss in pay, mental anguish, loss of dignity and other injuries on Oct. 7, 2016 as a result of allegedly being terminating for his medical condition and his need for chemotherapy treatments.

The plaintiff holds the defendant responsible for allegedly terminating his employment in bad faith and for allegedly acting with malice and reckless disregard for his rights.

The plaintiff requests a trial by jury and seeks judgment against defendant for economic damages, compensatory damages, punitive damages, attorney's fees and costs. He is represented by Mark J. Beutler of Law Offices of Mark J. Beutler PA in Miami.
