Universal Property and Casualty Insurance Company accused of breach of contract

FORT LAUDERDALE — A Florida resident is suing Universal Property and Casualty Insurance Company for alleged breach of contract.

James Joseph filed a complaint on June 12 in the Broward County Circuit Court, alleging that the defendant breached its duty of good faith and fair dealing.

According to the complaint, the plaintiff alleges that his property sustained a covered loss on February 18 as a result of water damage from the roof. Though the plaintiff allegedly filed a timely notice of the loss, the defendant allegedly denied coverage for the claim. 

The plaintiff holds the defendant responsible for allegedly failing to acknowledge coverage for the loss and make any payments.

The plaintiff requests a trial by jury and seeks judgment against the defendant for damages plus interest, court costs, attorney's fees and further relief the court deems just. He is represented by Scott Jay Senft of Law Offices of Scott Jay Senft LLC in Dania Beach.
