St. Johns Insurance Company accused of breach of contract

ORLANDO — Two homeowners are suing St. Johns Insurance Company for alleged breach of contract.

David and Alecia Walfall filed a complaint on June 21 in the Orange Circuit Court, alleging that the insurance carrier breached its duty of good faith and fair dealing.

According to the complaint, the plaintiffs allege that their sustained a covered loss on March 26, 2016 as a result of wind, water and/or hail. Though the plaintiffs allegedly filed a timely notice of the loss, the defendant allegedly refused to pay either part or all of the plaintiffs' claim. 

The plaintiffs hold the defendant responsible for allegedly obligating them to retain and pay for the services of a legal counsel to represent and protect their interests, and for allegedly refusing to pay the full amount of insurance proceeds to the plaintiffs.

The plaintiffs request a trial by jury and seek judgment against defendant for damages which exceed $15,000 plus statutory interest, costs and attorney's fees. They are represented by Saul Escobar of Escobar & DeCarlo LLC in Miami.
