American Integrity Insurance Company of Florida accused of breaching contract

Law money 06

ORLANDO — A Florida couple is suing American Integrity Insurance Company of Florida for alleged breach of contract.

Karen and Michael Montgomery filed a complaint on June 20 in the Orange County Circuit Court, alleging that the insurance carrier breached its duty of good faith and fair dealing.

According to the complaint, the plaintiff alleges that their dwelling suffered damages on Aug. 10, 2016 due a roof leak during a windstorm. The plaintiffs allegedly attempted to resolve the disputed claim with the defendant through mediation, but no agreement was reached.

The plaintiffs hold the defendant responsible for allegedly failing to comply with its contractual obligations and for not fully indemnifying them for the covered loss.

The plaintiffs request a trial by jury and seek judgment against the defendant for  damages plus interest, attorney’s fees, costs and other relief the court deems appropriate. They are represented by Candise L. Shanbron of Cernitz Shanbron LLC in Miami.

Orange County Circuit Court case number 17-C-5651
