Woman claims she was injured when go-cart was struck by another at Fun Spot of Florida

ORLANDO – An Orlando amusement park is facing a suit from a woman who alleges she was injured on a go-cart ride.

Elianna Simpson filed a complaint on June 13 in the 9th Judicial Circuit Court of Florida - Orange County against Fun Spot of Florida Inc. alleging negligence.

According to the complaint, the plaintiff alleges that on Aug. 3, 2015, she was an invitee at defendant's premises and while she was operating a go-kart attraction, her cart unexpectedly shut off causing her to come to an abrupt stop. The suit states that she was subsequently hit by another unknown go-kart operator at a high rate of speed, causing her injuries and damages. 

The plaintiff holds Fun Spot of Florida Inc. responsible because the defendant allegedly failed to inspect and maintain the go-karts in a reasonably safe condition, failed to take reasonable measures to correct the dangerous condition and failed to properly warn plaintiff.

The plaintiff requests a trial by jury and seeks judgment for damages against defendant of more than $15,000 exclusive of interest and costs. She is represented by C. Todd Smith of C. Todd Smith PA in Orlando.
