Woman alleges crack in Hogan Properties parking lot caused fall

ORLANDO – A Brevard County woman alleges that she was injured in an Orange County parking lot because of a crack in the pavement.

Margaret McNeely filed a complaint on June 8 in the 9th Judicial Circuit Court of Florida - Orange County against Hogan Properties LLC alleging negligence.

According to the complaint, the plaintiff alleges that on June 19, 2016, she visited defendant's premises as a customer of one of its retail tenants when she tripped and fell to the ground from the large crack and uneven pavement of the parking lot. As a result, plaintiff alleges she sustained injuries in and about her body and extremities, resulting in pain and suffering, disability, scarring, mental anguish, medical expenses and aggravation of a previously existing condition. 

The plaintiff holds Hogan Properties LLC responsible because the defendant allegedly failed to properly maintain and or repair the parking lot and failed to properly warn plaintiff of the dangerous condition.

The plaintiff seeks judgment against defendant for damages of more than $15,000, plus interest and costs. She is represented by Derrick R. Connell of Morgan & Morgan PA in Melbourne.
