Windermere property owners accused insurer of breaching policy

Insurance 07

ORLANDO – The owners of a Windermere property allege their insurer has breached their policy because it failed to properly indemnify them for a property loss.

Kimberly and Scott Murphy filed a complaint on June 5 in the 9th Judicial Circuit Court of Florida - Orange County against Tower Hill Signature Insurance Co. alleging breach of contract.

According to the complaint, the plaintiffs allege that on May 4, 2016, their property sustained a covered loss as a result of wind, wind-driven rain and/or hail and submitted a claim to the defendant. The plaintiffs hold Tower Hill Signature Insurance Co. responsible because the defendant allegedly failed to adequately indemnify them for the loss.

The plaintiffs request a trial by jury and seek judgment against defendant for damages, plus interest, court costs and attorneys’ fees. They are represented by Louis A. Gonzalez and Zaf Glenn Goss of Trujillo Vargas Gonzalez & Hevia LLP in Orlando.
