FORT LAUDERDALE – A suit has been filed against the city of Weston after a man was struck by a baseball at a city park.
Gary V. Mattis Jr. filed a complaint on May 25 in the 17th Judicial Circuit Court of Florida - Broward County against the city of Weston, Florida alleging negligence.
According to the complaint, the plaintiff alleges that on April 5, 2016, he was at or about the batting cages at the city park on Saddle Club Road in Weston when he was struck violently by a baseball that had escaped from a defective cage's netting. He alleges he suffered bodily injury and resulting pain and suffering, aggravation of pre-existing condition, mental anguish, and incurred medical expenses.
The plaintiff holds the city of Weston, Florida responsible because the defendant allegedly failed its duty to maintain and supervise the premises where the accident occurred.
The plaintiff requests a trial by jury and seeks judgment against the defendant for damages and taxable costs. He is represented by David Kleinberg of Neufeld, Kleinberg & Pinkiert PA in Aventura.
