Driver seeks damages from cattle owners after striking cow in Orange County

ORLANDO – A motorist has filed a suit against two Winter Garden livestock owners after she struck a cow.

Linda Scott filed a complaint on May 26 in the 9th Judicial Circuit Court of Florida - Orange County against James W. and Susan A. Rushing alleging negligence.

According to the complaint, on April 6, 2015, the plaintiff was driving on Hancock Drive in Orange County when she struck a cow owned by the defendants. She alleges she was unable to avoid striking the animal. She alleges she has suffered bodily injury and resulting pain and suffering, disability, disfigurement, loss and expense of property damage, and aggravation of an existing condition because of the incident.

The plaintiff holds James W. and Susan A. Rushing responsible because the defendants allegedly failed to properly maintain control of their livestock.

The plaintiff requests a trial by jury and seeks judgment against defendants for damages, costs, interest and other relief as the court deems just. She is represented by Philip Judd Slotnick of Burnetti PA in Tampa.
