Bodyhealth.com seeks refund after meal shake product allegedly didn't meet specifications

CLEARWATER – A Clearwater business alleges it paid more than $100,000 to a Georgia corporation to manufacture a product that didn't meet specifications.

Bodyhealth.com LLC filed a complaint on May 17 in the 6th Judicial Circuit Court of Florida - Pinellas County against Biothrive Sciences Limited LLC alleging breach of contract and unjust enrichment.

According to the complaint, the plaintiff alleges that in May 19, 2016, it contracted defendant to manufacture PerfectAmino Power Meal Shake under plaintiff's name. As a result of defendant's alleged breach, the plaintiff claims it was constrained and prevented from selling the products and was not able refund its payment in a total sum of $103,926. The plaintiff holds Biothrive Sciences Limited LLC responsible because the defendant allegedly failed to manufacture the products consistent with the specifications and parameters, refused to manufacture the product consistent with the contract and refused to refund plaintiff's monies.

The plaintiff requests a trial by jury and seeks damages for the amount paid by plaintiff plus interest, costs for this action and such other appropriate relief. It is represented by Max R. Price of Law Offices of Max R. Price PA in Miami.
