Lauderhill homeowners allege water damages were greater than insurer's estimate

Insurance 10

FORT LAUDERDALE – The owners of a Lauderhill home allege that their property suffered damages greater than what was acknowledged by their insurer.

Karen and Floyd Vernon filed a complaint on June 19 in the 17th Judicial Circuit Court of Florida - Broward County against Homeowners Choice Property & Casualty Insurance Co. Inc. alleging breach of policy.

According to the complaint, the plaintiffs allege that on Dec. 8, 2016, while their property's insurance was in full force and effect, their home was damaged by an accidental water discharge from plumbing in the kitchen. The plaintiffs hold Homeowners Choice Property & Casualty Insurance Co. Inc. responsible because the defendant allegedly failed to acknowledge that additional payment would be forthcoming.

The plaintiffs request a trial by jury, attorney's fees, costs and further relief as the court deems just. They are represented by Anthony M. Lopez and Daniela Barreto of Marin, Eljaick & Lopez PL in Coconut Grove.
