Owner of Loving Start Child Care Learning Center alleged to have failed to pay back loan to aunt

FORT LAUDERDALE – A Broward County woman alleges her niece failed to pay money she borrowed to open a day care.

Mercy Hayes and Richard Corliss filed a complaint on May 18 in the 17th Judicial Circuit Court of Florida - Broward County against Maricela Hernandez and Loving Start Child Care Learning Center Inc. alleging unjust enrichment and other counts.

According to the complaint, beginning in 2013, Hayes lent Hernandez money to open Loving Start Child Care Learning Center Inc. The suit states that in December 2016, the parties agreed that the defendants owed $230,787.62 but that this amount has not been repaid.

The plaintiffs request a trial by jury and seek judgment against defendants for damages of more than $15,000 plus interest and further relief as the court deems just. They are represented by Michael A. Fischler of Fischler & Friedman PA in Fort Lauderdale.
