Xtensions Xpress LLC investor seeks inspection of financial records

FORT LAUDERDALE – A Michigan investor of a Broward County company alleges that it has failed to produce records for inspection.

Walter Banks filed a complaint on May 18 in the 17th Judicial Circuit Court of Florida - Broward County against Xtensions Xpress LLC citing member inspection of books and records.

According to the complaint, the plaintiff alleges that on Oct. 10, 2011, he was enticed by Lional Dalton to invest in the defendant's company for membership units, wherein he paid $15,000 in exchange for 50 percent of the total of defendant's outstanding membership units. On Jan. 12 and again on March 27, plaintiff alleges he sent written demands for inspection and copying of defendant's financial records, to which the defendant has not provided.

The plaintiff holds Xtensions Xpress LLC responsible because the defendant allegedly failed to timely make available for inspection any books and records in its possession.

The plaintiff seeks judgment in his favor, order defendant to submit books and records for inspection and copying, award attorney's fees and costs and additional relief as the court deems just. He is represented by Suzette L. Russomanno of Maspons Sellek Jacobs LLP in Coral Gables.
