Homeowner alleges Safepoint Insurance failed to fully indemnify him for water damage losses

FORT LAUDERDALE – A Pembroke Pines homeowner alleges his insurer has failed to property investigate his claim for water damages.

Marlon Husband filed a complaint on May 18 in the 9th Judicial Circuit Court of Florida - Orange County against Safepoint Insurance Co. alleging breach of contract.

According to the complaint, the plaintiff alleges that on Sept. 12, 2016, while his property was insured under a homeowners insurance policy, it sustained a covered loss for water damage. However, despite efforts of plaintiff to furnished timely notice of covered loss, the defendant allegedly has yet to fully indemnify the plaintiff for his loss.

The plaintiff holds Safepoint Insurance Co. responsible because the defendant allegedly failed and/or refused to properly investigate and/or evaluate the nature and extent of plaintiff's claim and damages and failed or refused to provide full and timely coverage under the policy for damages.

The plaintiff requests a trial by jury and seeks judgment against defendant for compensatory damages, interest, costs of action, attorney's fees and further relief as the court deems just. He is represented by Brittney J. Brinkworth of WM Law Group LLP in Miami Lakes.
