RMX Construction seeks payment from American Integrity Insurance Co.

CLEARWATER – A restoration company in Pinellas County alleges an insurance company failed to pay for repairs made to a property in full.

RMX Construction, as assignee of George Stafisz, filed a complaint on May 16 in the 6th Judicial Circuit Court of Florida - Pinellas County against American Integrity Insurance Co. of Florida alleging breach of contract.

According to the complaint, on June 7, 2016, Stafisz suffered damages to his Oldsmar property because of water loss and retained plaintiff to perform services and/or repairs at the property. The suit states that Stafisz authorized direct payment and authorized his property insurance rights, benefits, and proceeds to plaintiff for the repairs.

The plaintiff holds American Integrity Insurance Co. of Florida responsible because the defendant allegedly failed to comply with written contract as agreed by insurance company and property owner and failed and/or refused to make full payment of the property insurance coverage.

The plaintiff requests a trial by jury and seeks judgment for damages, payment of invoice/bill, interest, attorney fees, costs, and any other relief that the court deems just and proper. It is represented by Peter Mineo Jr. of The Mineo Salcedo Law Firm PA in Davie.
