Tower Hill Preferred Insurance Co. alleged to have failed to pay Davie property owners for claim

FORT LAUDERDALE – Owners of a Davie property allege that their insurer has failed to pay for their claim for water damage.

Jessica Bennett-Porto and Richard Porto filed a complaint on May 18 in the 17th Judicial Circuit Court of Florida - Broward County against Tower Hill Preferred Insurance Co. alleging breach of contract.

According to the complaint, the plaintiffs allege that on Dec. 17, 2016, while their property was insured under a homeowners insurance policy issued by the defendant, it sustained a covered loss for water damage due to a leaking pipe, which required necessary repairs and replacements, cleaning and other remedial measures. They allege that the defendant has failed to pay the amounts requested for repairs and failed to establish that it had reasonable proof it was not responsible for payment of damages.

The plaintiffs request a trial by jury and seek judgment against the defendant for damages, interest, attorney's fees, costs and other relief that the court deems just. They are represented by Thomas J. Morgan Jr. of Morgan Law Group PA in Coral Gables.
