Tenants allege landlord did not correct mold issue in Pembroke Pines apartment

FORT LAUDERDALE – Tenants of a Pembroke Pines apartment allege mold in the property has caused them to suffer severe illness.

Fredreka Kennedy and Tequan Williams filed a complaint on May 18 in the 17th Judicial Circuit Court of Florida - Broward County against Devonaire HC LLC alleging negligence for failure to maintain the premises and other counts.

According to the complaint, the plaintiffs allege that on Dec. 1, 2016, they entered into a rental agreement for the apartment and in January 2017, noticed mold development. The suit states they contacted the defendant regarding the issue but that it did not cure it.

The plaintiffs hold Devonaire HC LLC responsible because the defendant allegedly failed to disclose that the property previously suffered water intrusion and toxic mold presence.

The plaintiffs request a trial by jury and seek judgment against defendant for damages, attorney's fees, costs and other relief the court deems proper. They are represented by Matthew J. Militzok and Adi M. Reinstein of Militzok & Levy
