Shopper claims she was injured when boxes fell on her at a Best Buy store

FORT LAUDERDALE – A Broward County woman alleges that she was injured at the Plantation Best Buy store when boxes of merchandise fell on her.

Diana Fuster filed a complaint on May 12 in the 17th Judicial Circuit Court of Florida - Broward County against Best Buy Stores LP alleging negligence.

According to the complaint, the plaintiff alleges that on June 2, 2015, she was in the premises of the defendant's store when several large and heavy boxes came falling down from an elevated position and struck plaintiff. As a result, she alleges she suffered bodily injury in and about her body and extremities, resulting in pain and suffering, disability, scarring, mental anguish, loss of the enjoyment of life, medical expenses, loss of earnings and aggravation of pre-existing conditions. 

The plaintiff holds Best Buy Stores LP responsible because the defendant allegedly failed to discover a dangerous condition on the premises, failed to warn plaintiff of the dangerous boxes that could fall, and failed to inspect, maintain and/or repair the shelving where the boxes are kept.

The plaintiff requests a trial by jury and seeks judgment against defendant for damages, together with other relief that the court deems just. She is represented by Julio C. Acosta of Acosta Law in Coral Gables.
