Coral Springs tenant alleges grassy area caused fall

FORT LAUDERDALE – An apartment tenant alleges that she fell on the property because a light was not functioning at the time.

Prudence Lamanna filed a complaint on May 12 in 17th Judicial Circuit Court of Florida - Broward County against Mid-America Apartment Communities Inc. alleging negligence.

According to the complaint, the plaintiff alleges that on Dec. 9, 2015, she was a tenant at the defendant's The Preserve at Coral Square property. The suit states that as she was walking back towards her apartment from the mailroom, she stepped into a depression in a grassy area which caused her to slip and fall. She alleges she sustained severe injuries, fractures, abrasions, suffered disfigurement, mental anguish, loss of earnings and incurred medical expenses.

The plaintiff holds Mid-America Apartment Communities Inc. responsible because the defendant allegedly failed to keep its premises in a safe and proper condition for the use of its tenants and invitees and failed to warn its tenants and invitees of the dangerous condition.

The plaintiff requests a trial by jury and seeks judgment against defendant for damages, plus costs, interest and attorney's fees. She is represented by Chad E. Brocato of Brocato Legal Group in Fort Lauderdale.
