Deerfied Beach property owners allege insurer breached insurance contract

FORT LAUDERDALE – The owners of a Deerfield Beach property allege that their insurer has failed to cover damages as the result of a water loss.

Itir and Edward Stackpole filed a complaint on May 12 in the Broward Circuit Court against Universal Property & Casualty Insurance Co. citing breach of contract.

According to the complaint, the plaintiffs allege that on Dec. 3, 2016, while the plaintiffs' property was insured under a homeowners insurance policy, it sustained a covered loss for water damage including damage to the building, contents, and loss of use of the property and possessions therein. However, despite efforts of plaintiffs to furnished timely notice of covered loss and performed all obligations precedent to recover under the policy, the defendant allegedly has yet to pay either part or all of plaintiffs' claim. 

The plaintiffs hold Universal Property & Casualty Insurance Co. responsible because the defendant allegedly failed to acknowledge coverage for the loss, failed to make any payment of insurance proceeds, and obligated plaintiffs to retain and pay for the services of a legal counsel to represent and protect their interest.

The plaintiffs request a trial by jury and seek judgment against defendant for all damages under policy, coverage for full amount of loss, attorney's fees, prejudgment interest, costs and other relief that the court deems just. They are represented by Jesse R. Feldman of The Diener Firm PA in Plantation.
