Man alleges Ocwen Loan Servicing is attempting to collect on mortgage that doesn't exist

ORLANDO – An Orange County resident alleges a debt collector is attempting to collect payments on a mortgage that doesn't exist.

Jose F. Garcia filed a complaint on May 15 in the 9th Judicial Circuit Court of Florida - Orange County against Ocwen Loan Servicing LLC alleging violation of the Florida Fair Debt Collection Act and the Florida Deceptive and Unfair Trade Practices Act.

According to the complaint, the plaintiff alleges that the defendant has called him hundreds of times, sent numerous letters and even began foreclosure proceedings against him. He alleges there isn't a mortgage on his Orlando property.

The plaintiff holds Ocwen Loan Servicing LLC responsible because the defendant allegedly failed to correct its error despite numerous demands from plaintiff and engaged in a pattern of extortion and coercion to collect on illegitimate debts and mortgages.

The plaintiff requests a trial by jury and seeks judgment in his favor and against defendant, award punitive damages, injunctive relief, costs, attorney’s fees and costs, interest and any other relief the court deems just. He is represented by Jose F. Garcia of J. Garcia Law Firm in Orlando.
