Man claims property damage is a covered loss under Tower Hill Preferred Insurance policy

FORT LAUDERDALE – A Fort Lauderdale homeowner claims his insurer wrongfully refused to pay his claim for damages to the property.

Jean Claude Michel filed a complaint on May 11 in the 17th Judicial Circuit Court of Florida - Broward County against Tower Hill Preferred Insurance Co. alleging breach of contract.

According to the complaint, the plaintiff alleges that on Jan. 20, while his property was insured under a homeowners' insurance policy, it sustained a covered loss for water damage. However, despite efforts of plaintiff to furnish a timely notice of covered loss, the defendant allegedly has refused to pay either part or all of plaintiff's claim. 

The plaintiff requests a trial by jury and seeks judgment against defendant for more than $15,000, for all damages, attorney's fees, interest, costs, and other relief that the court deems just. He is represented by Erik D. Deiner of The Diener Firm PA in Plantation.
