Man seeks more than $15,000 after sand allegedly caused fall from bike in Sea Ranch Lakes

FORT LAUDERDALE – A bicyclist alleges sand from a construction project negligently left in the roadway caused him to fall.

Charles Stella filed a complaint on May 4 in the 17th Judicial Circuit Court of Florida - Broward County against All Star Pavers Inc., AT Franco Architectural Associates PA, RLS General  Services Inc., Maki500 LLC, Oliveira Trucking Inc., and Brian and Kathy Cavanagh alleging negligence.

According to the complaint, the plaintiff alleges that on Sept. 10, 2015, he was riding his bicycle in Sea Ranch Lakes on Seneca Road and was caused to fall because of sand that was in the roadway. He alleges there were no warning signs and that he suffered bodily injury and resulting pain and suffering, disability, mental anguish, incurred medical expenses and loss of earnings.

The plaintiff holds All Star Pavers Inc., AT Franco Architectural Associates PA, RLS General Services Inc., Maki500 LLC, Oliveira Trucking Inc., and Brian and Kathy Cavanagh responsible because the defendants allegedly failed to remove the sand from the roadway in a timely manner, failed to warn the general public of the dangerous condition and failed to supervise the sand delivery.

The plaintiff requests a trial by jury and seeks judgment against defendant for damages of more than $15,000, plus court costs and other relief as the court deems just. He is represented by Ken M. Frankel of Ken M. Frankel PA in Pompano Beach.
