ORLANDO – An Osceola County man alleges he was injured at an Orlando restaurant because of a chair.

Jimmie Walker Jr. filed a complaint on May 10 in the 9th Judicial Circuit Court of Florida - Orange County Circuit Court against TP-I-Drive LLC alleging negligence.

According to the complaint, the plaintiff alleges that on Oct. 18, 2015, he visited defendant’s Twin Peaks restaurant as a guest at the restaurant and was injured when the chair he was sitting on broke, causing him to fall. He claims he sustained bodily injury in and about his body and extremities, resulting in pain and suffering, disability, disfigurement, mental anguish, and incurred medical expenses.

The plaintiff holds TP-I-Drive LLC responsible because the defendant allegedly failed to maintain a chair thus creating a hazardous condition, failed to inspect or warn plaintiff of the danger of the chair breaking, and failing to correct the dangerous condition of the defective chair.

The plaintiff requests a trial by jury and seeks judgment against defendant for damages and demands judgment of more than $15,000 plus interest and costs. He is represented by Mario Romero of Morgan & Morgan PA in Kissimmee.
