Driver alleges State Farm has failed to pay underinsured motorist benefits

CLEARWATER – A St. Petersburg woman is seeking underinsured motorist benefits from her insurer.

Bozena Picho filed a complaint on May 8 in the 6th Judicial Circuit Court of Florida - Pinellas County against State Farm Mutual Automobile Insurance Co. alleging failure to pay.

According to the complaint, on May 11, 2012, the plaintiff was rear-ended while driving on 66th Street North in St. Petersburg by Edward Martin III. Because of the accident, the plaintiff allegedly suffered physical injuries and filed for coverage claims for underinsured motorist benefits under her policy of automobile insurance with the defendants, but the defendant has alleged failed to pay benefits.

The plaintiff seeks judgment for damages of more than $15,000, for costs, prejudgment interest and such other relief as the Court may deem proper. The plaintiff is represented by Bernard Kanner of Englander Fischer in St. Petersburg.
