Patron claims Family Dollar store allowed water to accumulate on floor, caused fall

CLEARWATER – A Family Dollar shopper alleges that he was injured because of water on the floor.

Kenneth Ray Crank filed a complaint on May 8 in the 6th Judicial Circuit Court of Florida - Pinellas County against Cole FD Portfolio IV LLC, doing business as Family Dollar Stores Inc., alleging negligence.

According to the complaint, the plaintiff alleges that on Oct. 13, 2016, he was a patron at the defendant's premises in St. Petersburg when he slipped and fell due to water that accumulated on the floor. As a result, Crank claims he suffered bodily injuries, loss of earnings and expense of hospitalization. 

The plaintiff holds Cole FD Portfolio IV LLC, doing business as Family Dollar Stores Inc., responsible because the defendant allegedly failed to warn invitees of the dangerous condition on the floor, failed to act reasonably under the facts and circumstances present and allowed water to accumulate on the floor constituting an unreasonable slipping hazard.

The plaintiff requests a trial by jury and seeks judgment for damages, costs, prejudgment interest and any other relief the court deems just and proper. He is represented by Brad Salter of Salter, Healy LLC in St. Petersburg.
