Homeowners seek declaratory judgment in suit against Florida Peninsula Insurance

FORT LAUDERDALE – The owners of a Coral Springs property have filed a suit against their insurer over repairs needed to the property.

Carla and Corey Hicks filed a complaint on April 27 in the 17th Judicial Circuit Court of Florida - Broward County against Florida Peninsula Insurance Co. seeking declaratory judgment.

According to the complaint, the plaintiffs allege that on Dec. 21, 2016, their insured property sustained a covered loss as a result of a sudden and accidental discharge of water from the plumbing system. They allege that to date, the defendant has failed to acknowledge its proposed repairs will indemnify the loss.

The plaintiffs hold Florida Peninsula Insurance Co. responsible because the defendant allegedly failed to provide names and background checks of all workers, failed to provide proof of liability and name plaintiffs as additional insured, and failed to provide adequate scope, pricing and level of quality needed to indemnify plaintiffs.

The plaintiffs request a trial by jury and seek judgment against defendant, declaratory relief, attorney's fees, costs, and other relief as the court deems proper. They are represented by Anthony M. Lopez of Marin, Eljaiek & Lopez PL in Coconut Grove.
