Motorist alleges she was injured in collision with Bees Trees & Lawn Care employee

Car accident 37

CLEARWATER – A Pasco County woman alleges she was injured in a Clearwater collision purportedly caused by an employee of a Pinellas County business.

Melissa Merritt filed a complaint on May 2 in the 6th Judicial Circuit Court of Florida - Pinellas County against Bees Trees & Lawn Care LLC citing vicarious liability and negligent hiring.

According to the complaint, the plaintiff alleges that on March 25, 2016, she was stopped at a red light at the intersection of 58th Avenue North and Ulmerton Road when she was rear-ended by Billy Watson, an employee of the defendant. She alleges she suffered bodily injury and resulting pain and suffering, mental pain and anguish, disability, disfigurement, incurred medical expenses and aggravation of a pre-existing condition as a result of the negligence of defendant's employee in operating a vehicle so that it collided with plaintiff's vehicle.

The plaintiff holds Bees Trees & Lawn Care LLC responsible because Watson allegedly failed to keep a proper lookout and failed to yield to the right of way and the defendant failed to make an appropriate investigation prior to hiring.

The plaintiff seeks judgment against defendant for damages of more than $15,000, exclusive of costs. She is represented by Megan Cummings of The Nurse Lawyer PA in Palm Harbor.
