Fort Lauderale homeowner files suit against insurer for alleged failure to pay claim

FORT LAUDERDALE – A homeowner alleges her insurer failed to cover damages to her property from water damage.

Adely Petit-Frere filed a complaint on April 24 in the 17th Circuit Court of Florida - Broward County against American Security Insurance Co. alleging breach of contract.

According to the complaint, the plaintiff alleges that her Fort Lauderdale insured property sustained a covered loss for water damage. However, despite efforts of plaintiff to furnished timely notice of covered loss and has performed all obligations precedent to recover under the policy, the defendant allegedly has yet to pay either part or all of plaintiff's claim. 

The plaintiff requests a trial by jury and seeks judgment against defendant for damages, attorney's fees, interest, costs and other relief deemed just. She is represented by Peter Mineo Jr. of The Mineo Salcedo Law Firm PA in Davie.
