Universal Property & Casualty Insurance Co. alleged to have breached contract regarding damage claim

CLEARWATER – A St. Petersburg homeowner alleges he is entitled to full coverage for damages his property sustained due to water.

Manuel Alvarez Elias filed a complaint on April 28 in the 6th Judicial Circuit Court of Florida - Pinellas County against Universal Property & Casualty Insurance Co. alleging breach of contract.

According to the complaint, the plaintiff alleges that, while his property was insured under a homeowner's insurance policy, it sustained a covered loss for water damage, including damage to contents. However, despite efforts of plaintiff to comply with all post-loss obligations, the defendant allegedly has yet to pay or deny the claim. 

The plaintiff holds Universal Property & Casualty Insurance Co. responsible because the defendant allegedly obligated plaintiff to retain and pay for the services of a legal counsel to represent and protect his interest, and refused to pay full amount or part of plaintiff's insurance claim.

The plaintiff requests a trial by jury and seeks judgment against defendant, an order that the plaintiff is entitled to full coverage of all damages, attorney's fees, prejudgment interest, costs and other relief that the court deems just.
