Couple claims water damage should be covered under Heritage Property Casualty Insurance policy

CLEARWATER – A couple claims damages to a Clearwater property should be covered under their insurance policy.

Wayne and Gay Phillips filed a complaint on April 27 in the 6th Judicial Circuit Court of Florida - Pinellas County against Heritage Property and Casualty Insurance alleging breach of contract.

According to the complaint, the plaintiffs allege that on Nov. 27, 2015, they suffered a covered loss under the policy at their Clearwater apartment and made a claim to defendant for water damage and collapse, but defendant denied benefits. The plaintiffs hold Heritage Property and Casualty Insurance responsible because the defendant allegedly failed to provide coverage for a covered loss and failed to provide benefits due and owing under the policy.

The plaintiffs seek judgment against defendant, all benefits entitled to plaintiffs, prejudgment interest, court costs, expert fees, attorneys' fees, and further relief that the court deems just. They are represented by Amy D. Boggs of The Law Office of Amy Boggs PA in St. Petersburg.
