ORLANDO – A Melbourne lawn care company is accused of only paying the regular wage rate for overtime work.

Sergio Rodriguez filed a complaint on April 13 in the U.S. District Court for the Middle District of Florida, Orlando Division against Save Grass Inc., Aurora Stone and Gravel LLC and Saul Ventura alleging that they violated the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that he was employed by the defendants as an hourly paid employee with an hourly rate of $10 per hour. He alleges he was compensated at his regular rate for overtime work. The plaintiff holds Save Grass Inc., Aurora Stone and Gravel LLC and Ventura responsible because the defendants allegedly failed to comply with FLSA standard of paying plaintiff overtime compensation at a rate of one-and-one-half times his regular rate of pay for all hours worked in excess of 40 per workweek during one or more work weeks.

The plaintiff requests a trial by jury and seeks judgment for unpaid overtime compensation, liquidated damages, reasonable attorneys' fees, costs incurred and any and all further relief that the court deems just and appropriate. He is represented by Matthew R. Gunter of Morgan and Morgan PA in Orlando.
