Tower Hill Prime Insurance Co. accused of breach of contract regarding damage claim

ORLANDO – An insurer is accused of refusing to pay for damages to a property.

Alron Construction LLC, as assignee of Timothy O'Brien, filed a complaint on April 25 in the 9th Judicial Circuit Court of Florida - Orange County against Tower Hill Prime Insurance Co. alleging breach of contract.

According to the complaint, on March 24, 2013, O'Brien's property was damaged by wind, hail or water and was insured under a policy from the defendant at the time. The plaintiff holds Tower Hill Prime Insurance Co. responsible because the defendant allegedly refused payment for O'Brien's covered loss.

The plaintiff requests a trial by jury and seeks judgment against defendant for all covered losses with interest on any overdue payments, declaratory relief, attorney's fees and costs. They are represented by Lee Jacobson of Hale, Hale & Jacobson PA in Orlando.
