Woman alleges TJ Maxx shopping cart caused injuries

CLEARWATER – A TJ Maxx shopper alleges she was injured because of a shopping cart.

Karen Lowell filed a complaint on April 24 in the 6th Judicial Circuit Court of Florida - Pinellas County against TJM Benefits Inc., doing business as TJ Maxx, alleging that the retail store failed to provide a reasonably safe environment for its business invitees.

According to the complaint, the plaintiff alleges that on July 22, 2016, she was at the defendant's store at the Countryside Centre shopping complex. She alleges she encountered a shopping cart on the sidewalk and attempted to move it, but in the process it suddenly moved and caused her to fall to the ground.

The plaintiff holds TJM Benefits Inc. responsible because the defendant allegedly failed to warn patrons of the unsafe condition of its shopping carts and failed to adequately inspect and maintain its shopping carts.

The plaintiff requests a trial by jury and seeks judgment against defendant for damages of more than $15,000, plus costs, interest and other relief the court deems just. She is represented by Michael L. Walker of Florin Roebig PA in Palm Harbor.
