Merchant Worthy Inc. accused of unjust enrichment, conversion

ORLANDO – A Pompano Beach merchant account provider is alleged to have wrongfully and fraudulently come into possession of more than $128,000.

Greenlight of PA LLC filed a complaint on April 17 in the 17th Judicial Circuit Court of Florida - Broward County against Merchant Worthy Inc. alleging breach of contract, unjust enrichment, conversion and civil theft.

According to the complaint, the plaintiff alleges that in June 2015, it entered into an agreement with the defendant for the processing of credit card transactions for plaintiff's e-commerce store. However, the defendant allegedly failed to make deposits for three transactions in 2016 that totaled $98,061 and failed to refund plaintiff for 24 weeks of the weekly reserves paid to the defendant, which totaled $30,000. 

The plaintiff holds Merchant Worthy Inc. responsible because the defendant allegedly failed to fulfill its contractual obligations by breaching the agreement and was unjustly enriched at the expense of plaintiff.

The plaintiff requests a trial by jury and seeks judgment against defendant for monetary damages, treble damages in the amount of $384,183, plus interest, attorney's fees, court costs and other relief the court deems just.
