Property owner claims insurer did not pay actual cash value for water damage

FORT LAUDERDALE – A Weston property owner claims that his insurer failed to pay the full actual cash value for damages to the property.

Eduardo Pazos filed a complaint on April 14 in the Broward Circuit Court against Certain Underwriters at Lloyd's alleging breach of insurance policy.

According to the complaint, the plaintiff alleges that on June 2, 2016, he suffered water damage to his insured property due to heavy rain and that the defendant paid an amount determined but its own adjuster's estimate. The suit states the plaintiff notified the defendant that he was in disagreement of its determination of the total amount of actual cash value of the loss under the insurance policy. 

The plaintiff holds Certain Underwriters at Lloyd's responsible because the defendant allegedly breached its duty under the insurance policy contract.

The plaintiff requests a trial by jury and seeks judgment in his favor for damages of more than $15,000, plus interest, court costs and attorney's fees. He is represented by Kenneth R. Duboff of Duboff Law Firm in North Miami.
