The Toasted Monkey patron alleges he fell through floor

CLEARWATER – A man alleges he was injured at a St. Pete Beach establishment because a floor caved in.

Benjamin Eugene Webb Jr. filed a complaint on April 17 in the 6th Judicial Circuit Court of Florida - Pinellas County against The Toasted Monkey Inc. alleging negligence.

According to the complaint, the plaintiff alleges that on March 21, 2017, he was walking at the defendant's property and the wooden floor beneath him caved in, causing him to fall. He alleges he suffered serious and permanent personal injuries on his neck, back and leg.

The plaintiff holds The Toasted Monkey Inc. responsible because the defendant allegedly failed to warn plaintiff of the dangerous condition and allowed a dangerous condition to exist for a long period of time.

The plaintiff requests a trial by jury and seeks judgment against defendant of more than $15,000 plus costs, interest on all liquidated damages. He is represented by Scott M. McPherson of Scott M. McPherson PA in New Port Richey.
