ORLANDO – An insurance company is accused of failing to timely respond to a water damage claim.

Water Damage Clean LLC, as assignee of Sandra Cherfrere, filed a complaint on April 17 in the Broward Circuit Court against Universal Property & Casualty Insurance Co. alleging breach of policy.

According to the complaint, the plaintiff alleges that on Dec. 31, 2016, Cherfrere observed water damage to a Miramar property from a plumbing leak and retained the services of Water Damage Clean to perform emergency mitigation services. However, the defendant has allegedly failed to issue a payment or correspondence explaining a denial in coverage.

The plaintiff requests a trial by jury and seeks judgment against defendant and further relief the court deems just. It is represented by John S. Bernstein of Bernstein Polsky in Fort Lauderdale.
